SHAMOKIN – A private criminal complaint filed against 11 valley politicians – including the Northumberland County District Attorney – by a Shamokin resident led to erroneous charges being filed on the Pennsylvania Courts Administration Office (APOC) online system Monday.
According to Northumberland County Court Administrator Kevin O’Hearn, the charges were withdrawn and placed on “judicial hold” because they were not approved by any district attorney.
A potential court date was set for the end of July before a senior district judge to dismiss the private complaint filed by Shamokin resident Michael Robinson after filing a private criminal complaint against Shamokin Scott Roughton council members Barbara Moyer. Charles Verano and Jennifer. Seidel, as well as Shamokin Mayor John Brown, Shamokin Town Administrator Robert Slaby, Northumberland County Attorney Tony Matulewicz, Northumberland County Detective Degg Stark, the former City of Shamokin Rick Bozza and several others several months ago.
O’Hearn said the charges were entered into the state’s online system on Monday, then promptly withdrawn and put on “judicial stay.” According to O’Hearn, state rules state that private criminal complaints must be approved or dismissed by the district attorney.
“All of our district judges recused themselves, so it went to Berks County Senior Magistrate Gloria Stitzel, who signed the documents in order to secure a hearing,” O’Hearn said. “This date has been set for July 20 inside Shamokin. The courtroom of District Judge John Gembic, but these charges cannot be prosecuted because no Commonwealth prosecutor has approved the charges.”
Gembic declined to comment and said he recused himself from any case Robinson filed.
“The rules of criminal procedure state that a prosecutor must approve all private criminal complaints and, to my knowledge, no one has approved them,” Matulewicz said. “I have been very busy preparing for a triple murder hearing and will deal with it at a later date. I cannot allow nonsense to allow me to be diverted from doing what I am supposed to do . And that is to continue. “
The charges stem from illegal taking, obstruction of justice and various other allegations by Robinson, according to O’Hearn. None of the charges laid were investigated by a law enforcement agency, and none of the allegations were investigated by a law enforcement agency, a O’Hearn said. Robinson has already filed complaints against several politicians and all charges have been dismissed, O’Hearn said.
O’Hearn said he would notify the public when the courts receive notification from APOC on next steps.
